Introduction and Acceptance

Welcome to High Flyer FX Gold Strategy (the "Service"). The Service is a systematic trading strategy and AI auto-execution toolkit for XAUUSD (spot gold). It helps you connect your MT5 trading account to a strategy engine that executes trades automatically according to predefined rules.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of them, please do not use the Service.

Service Description

The Service provides a strategy-connectivity and auto-execution platform. You supply your own MT5 account and trading password; the strategy engine then opens and closes positions on your account according to the selected XAUUSD strategy. The Service does not touch your funds and performs no deposit, withdrawal, or discretionary asset-management on your behalf. Your capital always remains in your own third-party brokerage account.

Accounts and Registration

  1. Account Creation: Some features require a verified account. Please provide accurate information during registration.
  2. Account Security: You are responsible for safeguarding your credentials and for all activity under your account.
  3. User Responsibilities: Notify us immediately of any unauthorized use or security breach.

Third-Party Brokers

The Service executes trades through integrations with third-party brokerage platforms. Each platform is regulated by the authorities in its operating jurisdiction; regulatory status is disclosed by the platform itself. The Service does not endorse or guarantee any third party's regulatory standing, service quality, or trading outcomes.

Fees and Settlement

  • The first week is a free trial with no charges.
  • After the trial, if the selected strategy realizes a net profit in a given period, a performance fee of 30% of that profit is automatically deducted from your prepaid gold-coin balance.
  • If there is no net profit in a period, no fee is charged.
  • Fees, once deducted, are generally non-refundable unless required by applicable law.

Risk Disclosure

Leveraged products such as XAUUSD carry high risk and may result in partial or total loss of capital. Historical backtests and past performance do not guarantee future results. You should decide independently based on your own risk tolerance and bear all trading outcomes. The Service is not investment advice and makes no promise of returns.

Prohibited Activities

You agree not to:

  • Unauthorized access, copying, or redistribution of the Service's proprietary code, strategy logic, or documentation;
  • Use the Service for any illegal or unauthorized purpose;
  • Interfere with or disrupt the security or operation of the Service;
  • Attempt to bypass any security mechanism of the Service.

Intellectual Property

All content provided through the Service (including strategy logic, interface, documentation, and code) is protected by copyright and other IP laws and is owned by highflyerfx.com. You retain rights to your own configurations and customizations, but may not claim ownership of the core platform or templates.

Privacy and Data

We collect and use your information per our separate Privacy Policy. We collect only the minimum information required to operate the Service and take measures to protect your data.

Termination

We may terminate or suspend your access at our sole discretion, without notice, if you violate these Terms or harm the Service, other users, or third parties.

Disclaimer

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties regarding its accuracy, reliability, or availability.

Limitation of Liability

To the fullest extent permitted by law, highflyerfx.com shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from use of or inability to use the Service.

Changes to These Terms

We may update these Terms at any time. Changes take effect upon posting; continued use after changes constitutes acceptance.
